FCA court victory gives clarity to SMEs over Covid disruption

Court ruling will see a larger number of businesses receive payouts from their insurers

The UK’s Supreme Court has sided with the Financial Conduct Authority in a landmark ruling that clarifies whether small businesses can claim against business interruption insurance during the pandemic.

“Our aim throughout this test case has been to get clarity for as wide a range of parties as possible, as quickly as possible,” says Sheldon Mills, executive director for consumers and competition at the FCA. 

“[The] judgment decisively removes many of the roadblocks to claims by policyholders,”
